European Citizens´Initiative „Unconditional Basic Income“

Dear Participant,

 

Noch einmal einige Informationen für unser Meeting am 26. - 27. April 2012 bezüglich der Europäischen Bürgerinitiative „Bedingungsloses Grundeinkommen“.

 

Again some further information for our meeting 26th - 27th 2012 concerning the European Citizens´Initiative „Unconditional Basic Income“.

 

Die vorgeschlagene Tagesordnung ist als Attachment 1 beigefügt. Attachment 2 zeigt die aktualisierte Teilnehmerliste.

 

The proposed Agenda is given as Attachment 1. Attachment 2 shows the latest list of participants.

 

Bis 14 Uhr können sich alle vor dem Haupteingang des Europäischen Parlamentes sammeln und dann am besten gesammelt oder in kleineren Gruppen in die Vorhalle gehen. Der Haupteingang befindet sich an der Place Luxembourg, über dem Eingang steht der Name des Gebäudes, "Altiero Spinelli". In der Vorhalle wird uns Matthias Möller an einem der Empfangsschalter erwarten und wird uns die Badges ausgeben. Er wird ein kleines Schild aufstellen, an dem man ihn erkennen kann. Nachdem alle Badges ausgeteilt sind, werden wir zusammen zum Konferenzraum gehen.

 

Until 2.p.m. we could join us in front of the main entrance of the European Parliament and afterwards all of us or in small groups go into the entrance hall. Matthias Möller will be waiting from 2 p.m. on in the entrance hall of the Altiero Spinelli Building, accessible via the European Parliament main entrance at Place Luxembourg. There, Matthias Möller will be waiting at the counter to give out the badges. He will have a sign indicating the event. As soon as everybody got the badge, we will go to the conference room together.

 

Zur inhaltlichen Vorbereitung auf unser Meeting ist dieses E-mail vielleicht auch hilfreich. Attachment 3 zeigt Version 3 des Textes für unsere Bürgerinitiative „Bedingungsloses Grundeinkommen. Attachment 4 zeigt die Version 4.

 

This E-mail contains some Information, which can be helpful for preparation for our meeting. Attachment 3 shows Version 3 of the text of our citizens´initiative „Unconditional Basic Income“. Attachment 4 shows Version 4.

 

1. Warum werden zwei Versionen vorgelegt?

 

1. Why we have foreseen two versions?

 

Nachdem Bin-Italia ebenfalls an einem Vorschlag für eine EBI arbeitete, wurde in einem Meeting in Rom am 12. Febr. 2012 vereinbart, dass man versuchen sollte, die vorliegende Version 3 mit den Vorstellungen von Bin-Italia in Übereinstimmung zu bringen.

 

Bin-Italia had prepared also a proposal for an ECI. In a meeting in Rome at 12th February 2012 it was agreed, that we should try to come to a common text.

 

Da es jedoch zwei wesentliche Unterschiede gab, wurde ein Vorschlag (Version 4) für die Diskussion am 26. - 27. April 2012 ausgearbeitet, um dann zu entscheiden, ob diese Vorstellungen aufgegriffen werden sollen.

 

Because of the fact, that there are two main differences, a Version 4 was elaborated for discussion in our meeting 26th - 27th April 2012, where decisions should be taken for accepting or not of the proposals.

 

2. Welche juristischen und politischen Argumente sprechen für oder gegen Version 3 bzw. Version 4?

 

2. What legal and political arguments are for and against Version 3 and Version 4?

 

In Version 4 wird eine EU-Richtlinie (a legally binding act) verlangt, die den Mitgliedstaaten die Einführung des BGE nach den vorgegebenen 4 Kriterien (allgemein, personenbezogen, bedingungslos in existenz- und teilhabesichernder Höhe) vorschreibt und bezüglich der nationalen Implementierungs- bzw. Einführungsschritte nur den Spielraum „member states will be responsible choosing the best ways“ offen lässt.

 

In Version 4 an EU-directive (legal binding act) will be required, in which Member States will be stipulated to introduce the Unconditional Basic Income in accordance with the 4 criteria (universal, individual, unconditional, high enough to ensure an existence in dignity and participation in society). The freedom of the Member States for the introduction and implementation will be restricted to „member states will be responsible choosing the best ways“.

 

Dagegen hat man bei der Version 3 eine offenere Formulierung bei der Zielsetzung gewählt: „The EU-Commission is requested by the signatories to use up all its existing means and possibilities to speed up the introduction of an Unconditional Basic Income. It needs a legal right act in order to achieve the aims of the EU, to combat social exclusion and discrimination, and to promote social justice and social protection. Every person has the right to a life offering unconditionally secured livelihood and participation in society.“

Zusätzlich wurde den Mitgliedstaaten zugestanden, für die konkrete Umsetzung zuständig zu sein („Member states will be responsible for implementation“).

 

In Version 3 a more open formulation is used: „The EU-Commission is requested by the signatories to use up all its existing means and possibilities to speed up the introduction of an Unconditional Basic Income. It needs a legal right act in order to achieve the aims of the EU, to combat social exclusion and discrimination, and to promote social justice and social protection. Every person has the right to a life offering unconditionally secured livelihood and participation in society.“

Additionally it was foreseen, that Member States should be responsible for concrete implementation.

 

Aus diesen beiden Ansätzen ergeben sich unterschiedliche Konsequenzen:

 

There are different consequences related to these both versions.

 

A) Im Falle der Version 4 ist die Auslegung, ob es sich hier noch um eine „Umsetzung“ des EU-Vertrages handelt (und sie daher als EBI zweifelsfrei zulässig sei) oder bereits um eine „Änderung“ (weil die EU-Kommission sagen kann, dass sie für eine EU-Richtlinie in diesem Bereich keine Kompetenz habe) nicht zweifelsfrei zu beantworten.

 

A) In the case of Version 4 it is not without doubt clear, if we deal with a „translation“ of the treaty of the European Union (and therefore is acceptable without doubt as ECI) or if this is already regarded as a „change“ (and than the EU-Commissions might say, it is out of their competence to formulate an EU-directive in this area).

 

Juristisch sollte eine Registrierung der Version 4 vertretbar sein (siehe Attachment 5) und politisch auf jeden Fall, jedoch besteht ein großes Risiko, dass die EU-Kommission eine Registrierung trotzdem ablehnt.

 

A registration of Version 4 should be legally acceptable (see Attachment 5) and political in any case, but there is a big risk, that the EU-Commission will not register this ECI.

 

Es gibt aber auch eine Meinung, dass die EBI für uns einen Sinn gibt als Instrument zur Europäisierung der Debatte um das BGE, nicht aber als Versuch, es tatsächlich in der EU einzuführen. Ausgerechnet die EU Kommission als Teil der Troika, die gerade europaweit mit dem Fiskalpakt eine radikalisierte Form von Neoliberalismus zum Vorrang vor den nationalen Verfassungen verhilft, soll ein BGE einführen? Hier gibt es starke Zweifel.

 

There is also an opinion, that the ECI makes sense for the European wide debate concerning the UBI, but not for the introduction in the EU. There exist doubt, that the EU-Commission as part of the Troika, which just European wide  with the Finance Stability Mechanism (radical Neoliberalism) give priority against the national treaties, will introduce an emancipatory UBI. 

 

Auf jeden Fall gibt es mehrere Möglichkeiten der weiteren Vorgangsweise. Einige Beispiele:

 

In any case there are some possibilities for further actions: Some examples:

 

a) Sofort nochmals um Registrierung ansuchen, aber jetzt mit dem Text der Version 3, deren Ablehnung sehr unwahrscheinlich ist.

 

a) Immediately ask for registration, but now with the text of Version 3, which will be probably not refused.

 

b) Ein Verfahren gegen die Ablehnung beim EuGH starten. Allerdings wäre es ungünstig, eine BGE-Kampagne für ganze 2 Jahre ruhen zu lassen, bis der EuGH etwa 2014 (positiv oder negativ) entschieden hat.

 

b) To initiate legal proceedings against the refusal at the EuGH. But it would be unfavourable, to stop a UCI-Campagne for about 2 years, in order to wait of the outcome of the EuGH 2014 (positive or negative).

 

c) Mediale Nutzung eines Ärgers über eine mögliche ungerechte Entscheidung der Kommission für eine BGE-Kampagne verwenden.

 

c) To use a medial information about the annoyance of the unjustified decision of the Commission for a UBI-campagne.

 

d) Die Version 4 gar nicht vorschlagen.

 

d) Not to propose Version 4.

 

B) Im Falle der Version 3 ist eine Registrierung wahrscheinlicher. Allerdings könnte eine schwächere Forderung für eine BGE-Kampagne manche davon abhalten, eine Unterstützungserklärung abzugeben bzw. sich aktiv für die BGE-Kampagne einzusetzen. Wenn hingegen die Maximalforderung der Version 4 zumindest versucht wurde, aber von der Kommission als nicht zulässige EBI-Forderung abgelehnt wurde, ist dies ein starkes Argument, dass wir uns dann für das momentan maximal Mögliche einsetzen.

 

B) In the case of Version 3 the registration is more likely. But a more soft requirement for the UBI-campagne could prevent some persons to give support and to engage themselves in the UBI-campagne. But if we would require at first the maximum requirement and the Commission would refuse the ECI, it would be a strong argument, that we now ask for what is in the moment maximal possible.

 

C) Registrierung zum Zeitpunkt des BIEN-Kongresses (14. Sept. 2012) ist jedenfalls ein großer Vorteil bezüglich öffentlicher Verbreitung der BGE-Kampagne und sollte ein wesentliches Ziel sein.

 

C) The launch of the registration at the BIEN-conference (14. - 16. Sept. 2012) would be a big advantage in relation of the publicity for the UBI-campagne and should be an important aim.

 

3. Was sind die Unterschiede im Text der Version 3 und 4?

 

3. What are the differences in the text of Version 3 and 4?

 

In der Version 3 ist alles SCHWARZ geschrieben (siehe Attachment 3). In der Version 4 sind gegenüber der Version 3 geänderte Stellen ROT geschrieben (siehe Attachment 4).

 

In the Version 3 everything is written in BLACK (see Attachment 3). In Version 4 are all changed texts given in RED (see Attachment).

a) Hier ist Article 5(3) bei Version 3 als Artikel unter TFEU angegeben. In der Version 4 fehlt der Artikel.

b) Artikel 5(3) von TEU ist bei Version 4 hinzugefügt, denn darauf baut z.B. ein Teil der Argumentation auf, warum wir eine EU-Richtlinie brauchen.

 

b) Article 5(3) of TEU is added in Version 4, because part of the argumentation is based on that Article, why we need a EU-directve.
